1. Scope and provider
These terms govern the purchase of digital content via langpacks.com (including langpacks.de) between

(hereinafter “we” or “LangPacks”)
and consumers as well as traders (hereinafter “you” or “customer”).
A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed. A trader is a natural or legal person or a partnership with legal capacity who, when concluding the contract, acts in the exercise of their commercial or independent professional activity.
Conflicting customer terms do not apply unless we expressly agree to them in writing.
2. Subject of the contract
The contract is for the one-time provision of digital content, namely preconfigured Anki decks in .apkg format (vocabulary and course packs) for download. These are digital products not supplied on a tangible medium.
Anki is independent third-party software. The contract does not include the Anki software itself. Installation, operation and licensing of Anki are the responsibility of the respective Anki provider.
The essential characteristics of each pack are set out in the product description on the website.
3. Formation of the contract
The display of packs on the website is not a binding offer, but an invitation to place an order.
By clicking the buy button and completing payment on Stripe’s page, you make a binding offer to purchase the selected pack. The contract is concluded when payment is successfully authorised and we accept the order. Acceptance occurs by making the download available or by sending a confirmation email.
Before completing payment you can review and correct your details on the Stripe Checkout page. Placing the order involves an obligation to pay.
The contract language is German or English, depending on the language selected on the website.
We do not store the contract text separately. The relevant terms follow from these conditions, the product description and the order overview at Stripe.
4. Prices and small-business VAT scheme
All prices are total prices in euro. Under the German small-business scheme (section 19 UStG), no VAT is charged.
There are no shipping costs.
5. Payment
Payment is made exclusively via Stripe Checkout. Stripe accepts the payment methods offered there (e.g. card or other methods enabled by Stripe).
Charging takes place on conclusion of the contract or according to the rules of the payment method used. We may withhold the file until payment has been made in full.
6. Provision / download
After successful payment you receive access to download the .apkg file (usually immediately via the success page and/or your account, if any).
You are responsible for a suitable environment (in particular a current Anki installation and sufficient storage).

7. Licence
Upon full payment we grant you a simple, personal, non-exclusive, non-transferable and non-sublicensable right to use the purchased content for your own learning, to import it into Anki and to use it privately.
In particular, the following are not permitted: sharing, selling, renting, making publicly available, uploading to shared decks/libraries, copying for transfer to third parties, or use for your own commercial offering.
All copyright in the content remains with us unless expressly agreed otherwise.
8. Right of withdrawal for consumers
Consumers have a statutory right of withdrawal. Traders have no right of withdrawal.

The withdrawal period is 14 days from the day of the conclusion of the contract.

of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or email). You may use the attached model withdrawal form, but it is not obligatory.
You can also exercise your right of withdrawal online at https://langpacks.com/en/widerruf (button “Withdraw from contract”). If you use this online function, we will send you without delay, on a durable medium (e.g. by email), an acknowledgement of receipt containing the content of the withdrawal declaration and the date and time of its receipt.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
Expiry of the right of withdrawal
The right of withdrawal expires in the case of a contract for the supply of digital content which is not supplied on a tangible medium if we have begun performance after you have
1. expressly consented to us beginning performance before the end of the withdrawal period,
2. confirmed that you acknowledge that you lose your right of withdrawal by giving that consent, and
3. we have provided you with a confirmation pursuant to section 312f of the German Civil Code (BGB).
Without these conditions, the right of withdrawal continues even after the download has started.

9. Warranty
The statutory rules on the supply of digital products (sections 327 et seq. BGB) apply.
The content is learning material. It does not replace language teaching, an examination, or professional advice (e.g. medical or legal advice for specialist packs). No particular learning outcome is owed.
10. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, and to the extent of any guarantee we have given.
In the event of slightly negligent breach of essential contractual duties (duties whose fulfilment makes proper performance of the contract possible in the first place and on whose observance you may regularly rely), liability is limited to the foreseeable damage typical of this type of contract.
Otherwise, liability for slight negligence is excluded.
These liability rules also apply in favour of our vicarious agents.
11. User account
An account is optional. You must keep login details confidential and provide accurate information. We may suspend or delete accounts that are misused or that breach these terms.
12. Governing law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
Mandatory consumer-protection rules of the country in which you have your habitual residence remain unaffected.
13. Consumer dispute resolution
We are neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration board.
14. Final provisions
If a provision of these terms is invalid, the remainder of the contract remains effective. The invalid provision is replaced by the statutory rule.
